is permitted access to any area of the premises which has been designated as an area in
which patrons will not be permitted.
3. No viewing room may be occupied by more than one (1) person at any one time.
4. The application shall be sworn to be true and correct by the applicant.
G. REGULATIONS PERTAINING TO ADULT BOOKSTORES, ADULT VIDEO STORES,
ADULT MOTION PICTURE THEATERS, ADULT THEATERS AND NUDE MODEL
STUDIOS WITHOUT VIEWING ROOM(S) THAT HAVE BEEN DEFINED AS SEX
ORIENTED BUSINESSES:
A zoning clearance shall be required to insure that the aforementioned sex oriented businesses as
defined in this Section, are in compliance with the Use District, location and separation
distance(s) requirements.
H. ADVERTISING REGULATIONS:
1. As established in Section 601 (Sign Code): "No person shall exhibit, post or display a
sign or wall, any statement, symbol or picture of an obscene nature."
2. No depiction of specified sexual activities or specified anatomical areas shall be visible
from the exterior of the premises.
I. HOURS OF OPERATION: It shall be unlawful to operate, permit or cause to be operated a sex
oriented business, as defined in this Section, excluding an adult motel, between the hours of 1:00
a.m. and 8:00 a.m. on Monday through Saturday, or between the hours of 1:00 a.m. and 12:00
noon on Sunday.
J. EFFECTIVE DATE: This Section shall be in force and effective from and after thirty (30) days
following Board of Supervisor adoption.
A. PURPOSE: This article is adopted to protect the health, safety, and welfare of the community.
Except as allowed by law for personal, private use, Yavapai County enacts reasonable regulations
and requires compliance with laws for the retail sale, cultivation and manufacturing of marijuana
or marijuana products in a marijuana establishment or marijuana testing facility and the
cultivation, processing, and manufacturing of marijuana in a primary residence. Nothing in this
Ordinance is intended to promote or condone the sale, cultivation, manufacture, transport,
production, distribution, possession, or use of marijuana or marijuana products in violation of
any applicable law. In accordance with Article II, Sections 1 and 2, Constitution of Arizona, the
Yavapai County Board of Supervisors has considered the individual property rights and personal
liberties of the residents of the County before adopting this ordinance.
B. DEFINITIONS: The below words and phrases, wherever used in this article, shall be construed
as defined in this section unless, clearly from the context, a different meaning is intended. Words
used in the present tense include the future tense, words in the plural number include the singular
number, and words in the singular number include the plural number.
Chemical Extraction: means the process of removing a particular component of a mixture from others
present, including removing resinous tetrahydrocannabinol from marijuana.
